Deportation & Removal

If the government wants to remove you from the United States, there are several legal ways to prevent that from happening. Los Angeles immigration lawyer Mariela Caravetta has enjoyed success with all of them:

    • Waivers: Waivers for inadmissibility are granted when an individual can show that deportation will mean extreme hardship for your family.

    • Adjustment of status: Deportation can sometimes be prevented by changing your status based on a relationship to a U.S. citizen, or someone having lawful permanent resident (green card) status, or based on a labor certification filed by an employer. You may also be granted special status as an abused spouse, victim of a crime, a religious worker or a juvenile in foster care.
    • Cancellation of removal: There are two kinds of cancellation of removal, depending on whether you have lawful permanent resident (LPR) status. LPRs may apply if they have had that status for at least five years, resided in the U.S. for at least seven years and never been convicted of an aggravated felony. Non-LPRs must meet higher residency requirements, have an immediate family member who has green card or US Citizen status who will suffer hardship if you are deported, and be able to demonstrate good moral character.
    • Asylum: If you face persecution upon returning to your country on the basis of politics, race, ethnicity, religion or membership in a social group, you may be permitted to remain in the U.S. under asylum or refugee status. Asylum is sometimes available for individuals who, in their country of origins, were victims of domestic violence, crimes due to your sexual orientation or your cooperation with the government as witness.
    • NACARA & TPS: Relief from deportation for certain immigrants whose countries have been designated for this relief and have followed the registration process.
    • Other forms of Relief: Due to the changing nature of the immigration laws and the humanitarian arguments that can be raised on occasions, there are many other tailored forms of relief that may be available in your case, and depends of your particular circumstances.
